You can file H1-B extension based on your approved i-140 you should receive another 3 yrs extension i did the same.
Did you file this H1-B extension after changing employer using AC21? Is it approved for 3 years?

I have to do a emergency travel to India and I did not get my advance during that time. I went to USCIS office in person and got the advance parole and flyed to India.
Back in US I learnt from my wife that I got another copy of Advance parole which I have applied earlier. Both Parole documents look different in format and the one which I got from USCIS office does not have the SRC nubmer on it.
If my wife sends the recent Advance Parole documents via FEDEX, not sure which document I should show up at port of entry..Plese help.

Since when has more money than the prevailing wage been a problem?
If they pay you via a check to the company you own, then they will be paying for services rendered. They will not be paying employment taxes(SS+Medicare) on that check amount. You will end up paying Self employment taxes amounting to 15.2% on this amount instead of the 7.6% had it been part of your W2.
As far as the impact to the GC process. I dont think the excess amount should be a problem, but pls confirm with an imm.attorney

So the letter is just an employment continuation or verification letter and has nothing that states the spousal details or spouse's intention to accompany the H1 holder. I hope I got that right.

Employer 1(Very small company and doesn't exist anymore):
1) Labor cleared,
2) I-140 approved
Then Joined in another company (Multi billion company) Employer 2:
1) Labor cleared
2) Mistake: Didn't file I-140 and when priority dates were open in July 2007, they filed for I-485 with Old employer's I-140 and got EADs
3) Still waiting for Green card
My priority date: Sep 2002 (It is carried from first employer)
Still I am getting H1 B extensions - every 3 years with Employer 2
But my wife is working in EAD
In June 2010, we were informed by my company legal dept that they iled I485 incorrectly and they want to correct it. So they started over again.
1) Labor cleared
2) I-140 approved Mar 2011.
3) Priority dates are not current and waiting for it.
My options:1) Backout old I485 now and wait for priority dates and then reapply (Adv: No RFEs, No risk, high probability that we can retain Priority date. Diadv: My wife looses her job and get back to H4)
2) Backout I-485 when priority dates are open and reapply....(Adv: My can work longer and will get at least 90 days break. Disadv: Risk if get RFEs now or reject now before we reapply - risk to loose priority date)
Questions for you:1) Is there any way to file an ammendment to update new I-140 with my existing application without my wife getting impacted? If so, how much riskier it is?
2) Our attorney says we cannot do it because it is invalid I-485. And we have to file a new one. Is it?
3) Then does it mean my wife is working illegally?
4) When is the best time to backout (My wife is not happy to leave her current employer)?
5) Attorney says we have to update them with new I-140 if we get RFE asking for my second Employer's I-140. My question is, Why can't we do it now? How much riskier it is?

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

Well, the first thing that I noticed was not the ceiling, but rather the cute little Shetland Sheepdog in the middle of the walkway. Of course, I love dogs (and especially Shelties)... ;)
I think if I stare at the image long enough, I can sometimes see the effect you're talking about, though it's not like that effect jumps out at me. IMHO, this picture is still a good study of geometric forms, whether or not it has issues with optical illusions. :)

thanks!! it's always good to hear that i'm improving from someone as good as yourself. it was funny, as i was going back the dirt road, the party kids from the night before were on there way out, they don't know what they missed this morning.
That's why you get up at 4:30! My friends make fun of me for that... The successive ridgelines in the fog make for a real feeling of depth. I've tried that technique a few times, but never pulled it off this well. I also like the aspect ratio you chose, it contributes to the 3-D, receeding-to-a-point, effect. The color here is likewise very nice. The only thing I would say could be better is that the sun is distorted by the cloudline. It would be better if totally obscured, or better resolved. In any case, you can't control the clouds. Super shot.

I have a need to get my future spouse on H-4 visa. With EB3 India priority dates retrogressed, filing dependent I-485 for spouse is years away. (Unless rules change!)
Question 1: IF I loose my H1-b status (job loss) and find a new job using my EAD, my spouse on H-4 goes out of status. So what all options do I have to keep her in a valid status?
Question 2: Proactively, say my spouse (when on valid H-4 status) starts a Masters program (part-time) at a University, can she file for a H4 to F-1 change of status (COS) that very week or month I loose my job. Or are there any serious timing issues in this option?

Hi ,
I am in strange situation. I am in 7th year of H1B and I have applied for H1B extension which was expiring on April 4th through my company on Feb 14th through normal processing. I have the LIN number from receipt notice. I was never able to check the status online as the LIN number was not found and when attorney called USCIS regarding this on March 23rd, We were told that the information will be updated to see the status online. Our attorney did not follow up with USCIS since then. Our attorney followed up again just today and found that an RFE was sent on March 25th which was never received by attorney. Currently we do not know what exactly is requested in the RFE or dead line for the response. RFE was requested again today from USCIS and was told that will be received in around 30 days. Do you think new dead line will be given for the RFE as the initial deadline might have passed for the initial RFE. I am not sure what to do at this point if I am in status or not. Please provide your advise as to what I should be doing? Appreciate your advises.

I don't think it is necessary to renew his passport in India. I heard though they suggest having 6 month of passport validity, POE will let you in even if the passport is going to expire the next day. At the time of entry the passport they are carrying should be valid.
I read this in a blog but use it at your own discretion.
BTW is your son is on H4? How could he be able to come to US on 1st Sep 2009 when the H1B expired on 14th Jan 2009? (or is it a typo and should be read as 14th Jan 2010)

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?
