Even I am very worried about the same as my filling for H1 extn is going to come soon and due to the recent denials, I am very worried. I don't have EAD also with me and my priority date is very late. I heard about 3 cases where H1 extn is denied.

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

I am 25 yrs old. I have a green card since 2004. i did a stupid mistake by commiting a theft from a mall of less than 90 bucks in 2005. i pleaded guilty and i was sentenced one year suspended with probation (Didn't serve time) and some hours community service. At first it was a felony since it included a tool to remove a sensor. but then it was reduced to a misdemeanor. I have been good with the law ever since. I went to school have AA and bachelor degree in international business, I have my own business, pay taxes, so on and so forth.
Now I would love to be American citizen but i am afraid when they pull up my record they will see i am deportable. It has been almost 6 years but I am afraid i will be rejected. My green card expires on 2014. Any response is greatly appreciated.

Hi - I am on 7th Year of my H1. My I-140 has been approved. My I-485 is pending for while plus my PD is not current as of Jan 09. In this case...
a) Am I eligible to apply for H1 extension (I don't want to use EAD)?
b) If Yes, will I get 1 Year or 3 Years?

Hi,
First my 140 was filed in first week of april and got receipt notice with received date as 11-Apr-08, and in May it was rejected because of check bounce issue.
Again my 140 was refiled in july,and got my 140 receipt notice with received date as 24-Jul-08.
(My labour was approved on 23-Jan-08 and its expiration date is 21-Jul-08,
i think there is rule that 140 should be filed before 180 days of labour approval)
My lawyer is saying:
we first filed it well before the dates,so you should not have a problem, as this is refiled in follow up to the original one.
I am still wondering the USCIS will process my 140.

One of my friends applied for his GC thru a consulting company which he does not work for...He used to work for the company but left that company before he decided to file with them...Since he has good relations with the company, they decided to file for him.
The company recently filed his I140 but they got a RFE on I140. INS wants to know why does the company want to hire him and why he left the company in the first place..does anyone in the forum has a similar experience to share...The RFE is actually for the conmpany but the owner wants my friend to write a letter and mail it to the lawyer. Any help is appreciated.
First, employer or his agent only reply to RFE, not your friend.
Second, it is a simple stright forward RFE, unless INS found some fishy thing (or doubting as it is a bonafide sponsership) as employee not working for sponser. May be they are trying to control future employee loop hole. Employer can write the reason why he left and why they want to hire him back. It is a strightforward easy question to answer.

Now the PERM takes 2years... whats the difference for new guys? My friend stuck in labour for almost 15 months now. got RFE, replied to it and stood stand still..
But this helps for someone who filed during July'07 fiasco and waiting though. I got mine approved in late feb'09 (filed in July 07).
Something is better than nothing.... :-)

If you are a French citizen, then yes, you can get a new H1-B visa stamp at the US Embassy in Paris. But if you are a citizen of another country, then no, you cannot get a US H1-B visa in Paris. You have the option of getting an appointment and going to a US Embassy/Consulate in Canada, Mexico, or your country of citizenship.
Whether the French will give you a French visa is another question, but regardless, you will have to have a new US H1-B visa to get back into the country.

If your lawyer or you can get through to a person at BEC maybe you could get that person would agree to accept mail addressed to a specific person at the BEC, that way there would be someone to contact to check that they have it.
Obviously they wouldn't normally do that, but if someone there believes the lawyer that it was lost twice then they might take pitty.
That way you are dealing with someone rather than a black box.

Had an Infopass appointment today VA, Washington Field Office, just wanted to share the experience here.
Had appiled I-485 last year August, and case was transferred to Vermont and then back to Texas, had
never received my FP notice. Received EAD and AP from Vermont last year.
It was a really nice experience as first lady confirmed/checked my Priority date is current, and was very helpful, she immediatly scheduled an FP appointment for my wife and myself for Sep.4th, though I did not
inquire much about my case, she provided me with all the details. My wife's name check got cleared last year and mine got cleared just this July 31st, she also said that recently tsc centre worked on my case, and probably did not do much as FP is missing, she said that currently my case in the records room and not in examination room. When asked after FP on Sep 4. any chances me getting approved, for follow-up she said call TSC after two weeks they should able give u all the details.

The Part 3 of form I-539 is asking below questions:
1. I/We request that my/our current or requested status be extended until***** (mm/dd/yyyy): __________
Here, actually, I'm applying for change of status & not extension. Should I write N/A or the I-94 expiry date of my spouse's H1 petition?
2. Is this application based on an extension or change of status already granted to your spouse, child, or parent?
Here, should I say Yes or No??

I got my GC on the 30th of Nov. My current project ended on 31st Dec. My employer is not responding to my calls and emails asking him if I'll get paid on bench. He is not giving any clear answers and just dodging the direct questions.
I have a few very good offers in my hand as of now which I can take but those might put me in violation of some non-compete agreements that I signed. I also signed a 1 year 'bond' at the time of my I-485 filing in May.
I'm without work for the last 7 days and I won't know if he will pay me on bench before I get my paycheck end of january...
Some of the offers that I have can wait for a few more weeks...
What do you guys think I should do in this case..
Mainly worried about these aspects:
1. Non-compete agreements
2. Bond signed at the time of agreement
3. Leaving employer soon after getting my GC.
Please don't blast me for being a chicken even after getting my GC... I'm just trying to get the opinion of my fellow IVians...
