Hello Gurus,
My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.
I filed my I 485 in June 2007 and got EAD and AP
1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.
And what is 'H1 pending for 240 days rule'.

Until you get any decision on your H1 extension, you are still considered on H1.

I think she is ok, getting an H1-B approval doesn't mean that you have to start immediately. for e.g, many of the Indian tech companies get an H1-B at the start of the year and when they have a need for that person in US, send him/her over.
Only after her first payroll would she be considered on H1-B.

will not stamp visa if passport validity is less than 6 months.

My wife had that stamped in blank passport an year and half back and had no issues...
She had all the documents

Proof of marriage
Letter from me stating I will support her and that she will live with me in US
My bank statements (last 3 months)
A letter of support from my employer
nothing else comes to mind at this time... All the best. Nothing to worry about.

Not sure what to say. But I believe in your original H1 petition requested dates of employment were only for one and a half month and I think you will get only that. Unless attorney files an amendment and documentation for additional 3 years. I dont think USCIS will even look at I-140 approval since it was not eve part of the packet

That could be things like
NOID - Notice of intend to Deny.
RFE - Request for evidence.
For I-140 USCIS does not update the online status properly. For both of my EB3 and EB2 I-140s still the case status says they received the application and processing!
Wait for the document that they sent.

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.
Do let me know when your checks are cased.

Last time I have showed one copy. They have asked for the second one which I did not take with me.
The POE officer said that USCIS normally sends two copies one for the applicant and one for POE to retain as a proof of entry.
They also said it is ok if we don't take the second one with us.
They just took a copy of the first one and kept it for their records.

The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax
Return.
The probable reason of asking-to verify, that Company is sound, paying salary, wages, then taxes, including unemployment tax.
The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.
Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!

Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?

Hello all,
I received an RFE for employment verification. My ETA 750 list Occ Code as 15-1061 (Title - database Administrators). But in my new job I am working as .Net developer where I work with front end and back end development of their website. I work in C#, ASP.NET, java, Flash.
My attorney asked me to find tasks matching with O*net description of Occ Code 15-1061 . None of them directly relate, but some or part relates. Am I in trouble because I no longer work in database development.

Note that EAD is not a valid document for re-entry.
If you have a valid AP - you can re-enter
or
If you have a valid H1/H4 AND un-expired visa stamping - you can re-enter
I had my H1 extension pending and I was able to re-enter using AP (on July 18, 2008 at San Francisco)
She has the F1 stamped on the passport which is valid until Dec 2009 I think. She is finishing much before that. Does it mean she will not be able to reenter on either F1 visa or the EAD?

IV Members,
At some point of time you must have posed a question or had some issue that was pegging you. You tried to get answers from members and resolve issues. Time must have passed and you had an outcome for the issue you were worried/working. It would be nice if you post the experience what happened to the issue you were worried over the period of time. How it has been resolved or what is logical end.
For ex:
I posted a question about my worry about travel to india with out the reciept notice and finally it ended up recieving the notice 3 days before my travel. I have gone through different tensions in the process. IV forums helped me understand where I stood what actions I needed to take. I took those actions, and it resulted in a favourable outcome at the end.
This happened just because some one has posted their experience.
So it is just not posing the questions on the forums but as the time passes do update what happened to your question.
This helps many other IV members who may come across same situations. Some of the IV members do this but few others they just forgot to return back and update the members what happened to their situations later. Do care to let people who answered you know what was the result.
